A public offer for a donation contract.

1. What is the public offer

This public offer ( further “Offer”) is proposal of charity Foundation “Strelitzia”, that  works to assist people with  dementia and help their families and caregivers ( further “ Foundation”  and / or recipient of fundraising,  VAT number 3326013219, Registration number 1193328009863,  in person of Foundation President  Alekseeva Angelika, operating according to the Status of the Foundation, stipulated with any person or legal  entity  ( further “Donor”), the donation contract ( further “Contract”), under the conditions described below.

1.1. The offer is to be considered as public offer according to paragraph 2, Article 437 of the Russian Federation Codex.

1.2. The offer will be valid from the day after the date of publication on the website of charity Foundation at https://stelizia.ru (further “Site”).

1.3. The offer is valid without time limits. The Foundation has the right to stop the offer validity at any time without clarifying the reasons.

1.4. The offer can be modified, and its variation will enter into force from the day after the date of their publication on the site.

1.5. The invalidation of one or more conditions of offer does not involve the invalidation of all other offer conditions.

1.6. The Foundation has the right to stipulate donation contracts with reference to the offer differently from the one provided in Section 3

In this case, the value and application of the offer are determined by the terms of these contracts.

1.7. The Foundation can enter into donation contracts differently and / or in conditions other than those provided for in the offer, for which any person concerned must contact the Foundation. Pursuant to Article 428 of the Russian Civil Code, this offer is not an accession contract and the article itself is not an offer.

1.8. The offer is valid in the Russian Federation, has been prepared in the city of Yurijev-Polski, Vladimir Region

2. Procedure for the conclusion of the contract

2.1. The contract is concluded at the time of acceptance of the donor’s offer.

2.2. The offer can be performed by the donor in any way currently in force, ie:

2.2.1. Mediating transfer of money / transfer by the donor to the Foundation, and with the use of electrotonic terminals, of credit cards, electronic payment systems and other means and systems provided for by the offer;

2.2.2. By depositing money in the fundraising points established by the Foundation or by third parties on behalf and / for the benefit of the foundation in public places.

2.2.3. Through the recording of the donor on the site https://strelizia.ru, through the form for monthly or singular donation, to be charged on the credit card. If at the time of the monthly debit, the credit card is without liquidity, various attempts will be made to charge the amount specified by the benefactor at intervals of several days. The charge is valid until the cardholder is expired or before a written notification of cessation of the adhesion. The cancellation request must be sent to the e-mail address angelika.alekseeva@gmail.com  at least 15 calendar days before the date of the subsequent automatic charge. The warning must contain the following data: surname and name, as indicated on the credit card; The last four digits of the card with which the automatic fund must be charged; The e-mail address to which the beneficiary will send a regular termination / cancellation confirmation.

2.2.4. By sending SMS messages within the Foundation’s projects

2.3. If the donation transfer method chosen by the donor provides for the definition of “payment destination”, the donor will specify one of the following options:

1. A) Donation to the Charity Program________.

The non-taxable VAT (indicate the name of one of the “Strelitzia” charity programs, to which the donor wants to send

your donation),

1. B) Help donation to _________________. The non-taxable VAT (indicate the surname name of the person to which the donor wants to provide assistance);
2. C) Donation to the project ________________. Non-taxable VAT (indicate the name of one or more projects of the foundation, to which the donor wants to send his donation);
3. D) Donation for the treatment of elderly with dementia. Excluding VAT;
4. E) Donation for caregiver’s treatment. Non-taxable VAT
5. F) Donation for assets provided by the Statute. Non-taxable VAT;
6. G) a generic donation. The non-taxable VAT.

2.3.1. Upon receipt of the funds referred to in paragraph 2.3.A or in point 2.3.B, or in point 2.3. C, Foundation undertakes to send the help to the person indicated by the donor or the implementation of the specified / chosen charity program, respectively. In case the amount of donations received to the Foundation is aimed at a particular person / for a particular project / charity program and exceeds the amount needed to assist / implement the project / charity program, or the help of this Person / this project / this charity program, money will be directed to another project according to requested amount need.

 The Foundation informs donors by publishing information on the website and uses the amount exceed between the amount of received donations and the amount needed to help a specific person / for the realization of a specific project / specific charity, according to the statute of the Foundation in accordance with the Federal Law No135-FZ of 11.08.1995 “on charity activities. If the donor does not accept such variation of donation destination, he has the right to claim it within 14 calendar days after the publication of this information on the site to request in writing, asking for reimbursement related to its donations.

2.3.2. When receiving a donation without specifying the purpose and “payment destination”, mentioned in point 2.3. and 2.3.1. In this offer, the Foundation independently chooses the destination of using the donation received according to its charity program.

2.3.3. The donor declares to accept that no less than 80% of the received donation should be used for charity within one year from donation receipt by the Foundation, and the balance will be destinated during the year specified by the donor and used for charity in the calendar year, following the year in which the donation was received.

2.4. The amount of the donation is determined by the donor. 

2.5. Any action of the donor, mentioned in paragraph 2.2. is to be considered as acceptance of the same offer. In accordance with Part 3 of Article 438 of the Civil Code of the Russian Federation.

2.6. The date of acceptance of the offer and, consequently, the date of conclusion of the contract is the date of receipt of the funds from the donor on bank account of the Foundation – in case like mentioned in point 2.2.2- this will be the date of collection funds by legal representatives authorized by the Foundation to pick up at the donations from collection points.

2.7. In case of bank transfer, the donation can be transferred as mentioned  in Section 4 of this offer, as well as to the other bank details stated  on the https://strelizia.ru

3. Other conditions

3.1.By any actions according to this offer, the donor declares to accept the terms and conditions of this offer, share main goals  of the Foundation, charity programs, is aware of the importance of its actions, and declares to have understood and fully accepted the conditions of this offer.

3.2. This offer is regulated and interpreted in accordance with the legislation of Russian Federation.

3.3. The donor gives the consent to the processing of personal data (name, address, place of residence, e-mail address, banking coordinates, telephone number), also by third parties (based on contracts with the beneficiary), only for execution of this offer – data processing includes the following actions: collection, registration, cataloguing, accumulation, storage, clarification (update, modification), recovery, use, transfer (distribution, supply, access, cancellation, destruction of personal data. In all other cases, the Foundation undertakes not to disclose to third parties the personal donor data without its written consent. The exceptions are the requirements of this information by government officials who have the authority to request such information.

Consent to the processing of personal data is valid until the donor cancel/stop it in writing.

3.4. With the present, the donor agrees to receive by the Foundation of information material relating to charitable activity, including information on charitable expenses, through direct communications with all means of communication, including, by way of example but not exhaustive, consensus When receiving the newsletter is valid until the donor withdraws/ stops it in writing.
